Sound Promote, operated by Verbose Digital LLC ("we," "us," or "our"), operates the music promotion platform available at www.soundpromote.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform. Please also review our Terms of Service.

1. Information We Collect

We collect information that you provide directly to us, as well as information generated through your use of the platform:

  • Account information: Name, email address, password, organization or label name, and billing details.
  • Music files: Audio files, artwork, metadata, and related content you upload for promotion.
  • Contact lists: Recipient lists and contact information you import or create for promotional campaigns.
  • Usage data: Log data, device information, browser type, IP address, pages visited, features used, and interaction data such as email opens and link clicks.

Email Engagement Tracking

To provide campaign analytics to our users, we collect engagement data from promotional emails sent through the platform:

  • We use tracking pixels in promotional emails to measure when emails are opened.
  • We track link clicks within emails to measure recipient engagement.
  • We record download activity when recipients access shared tracks.
  • This data is aggregated and presented to our users as campaign analytics.

Third-Party Contact Data

Users upload contact lists containing personal data of third parties (such as DJs, curators, and media contacts) for the purpose of sending promotional campaigns. Sound Promote processes this data on behalf of the user, who acts as the data controller.

Users are responsible for ensuring they have a lawful basis or appropriate consent to share third-party contact data with Sound Promote.

Contacts included in these lists can request removal at any time by using the unsubscribe link included in every promotional email, or by contacting us directly at hello@soundpromote.com.

2. How We Use Your Information

  • Provide and operate the service: Process your promotional campaigns, send promotional emails on behalf of users to their contact lists, deliver content, host your music files, and manage your account.
  • Improve the platform: Analyze usage patterns to enhance features, fix issues, and develop new functionality.
  • Communicate with you: Send service-related notices, respond to support requests, and provide updates about your account or campaigns.
  • Ensure security and compliance: Detect and prevent fraud, abuse, and unauthorized access to the platform.

3. Data Storage and Security

We implement industry-standard technical and organizational measures to protect your data, including encryption in transit and at rest, access controls, and regular security assessments. While no method of electronic storage is completely secure, we are committed to protecting your information and promptly addressing any security incidents.

4. Third-Party Services

We use the following third-party providers to operate the platform. These providers are contractually obligated to protect your data and may only use it to perform services on our behalf:

  • Google Analytics / Google Tag Manager — website analytics and product insights
  • Resend — email delivery for promotional campaigns
  • Vercel — web hosting and deployment
  • Railway — application infrastructure
  • AWS S3 — audio file storage

5. Data Sharing

We do not sell, rent, or trade your personal information to third parties. We may share your data only in the following circumstances:

  • With your explicit consent.
  • With service providers who assist in operating the platform, subject to confidentiality obligations.

  • To protect the rights, safety, or property of Sound Promote, our users, or the public.

6. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data, subject to legal and contractual obligations.

  • Object: Object to processing of your personal data on grounds relating to your particular situation, including objecting to direct marketing.

8. CAN-SPAM and Email Marketing Compliance

All promotional emails sent through Sound Promote comply with the CAN-SPAM Act and applicable email marketing regulations:

  • Every promotional email includes a clear and functioning unsubscribe mechanism.
  • We honor opt-out requests promptly and ensure unsubscribed contacts are removed from future mailings.
  • Emails accurately identify the sender and include required physical address information.

9. Data Retention

We retain your personal data for as long as your account is active or as needed to provide services. After account deletion, we may retain certain data for a limited period to comply with legal obligations, resolve disputes, or enforce our agreements. Aggregate or de-identified data that can no longer identify you may be retained indefinitely.

10. Data Breach Notification

In the event of a data breach affecting personal information, we will notify affected users within 48 hours of discovery. We will also notify relevant supervisory authorities as required by GDPR (within 72 hours) and applicable state laws.

Notification will include:

  • The nature of the breach.
  • The categories and approximate scope of data affected.
  • The steps we have taken or propose to take to address the breach and mitigate its effects.

11. U.S. State Privacy Laws

Residents of certain U.S. states have additional privacy rights under state law. We do not sell personal information.

California (CCPA/CPRA)

California residents have the right to know what personal information we collect, the right to delete personal information, and the right to opt-out of the sale or sharing of personal information. Virginia (VCDPA), Colorado (CPA), and Texas (TDPSA)

Residents of Virginia, Colorado, and Texas have similar rights, including the right to access, correct, delete, and obtain a portable copy of personal data, as well as the right to opt out of targeted advertising and profiling. To exercise these rights, email hello@soundpromote.com.

We will respond to all verified consumer requests within 45 days. If additional time is needed, we will notify you of the extension and the reason.

12. Children's Privacy

Sound Promote is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a person under 18, we will take steps to delete that information promptly.

13. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have different data protection laws. When we transfer data internationally, we implement appropriate safeguards, such as standard contractual clauses, to ensure your data remains protected.

When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, providing additional notice through the platform or via email. Your continued use of Sound Promote after changes take effect constitutes acceptance of the updated policy.
